| Description | Franchisees are granted the right to operate a single business within a specific geographic area (Trade Area) containing approximately 100,000 – 115,000 Qualified Households (Owner Occupied Units). The exact geographic boundaries are determined by the franchisor based on criteria like household count and existing territorial rights, defined by streets, natural boundaries, zip codes, or cities/counties. The franchisor reserves the right to operate or license others to operate similar businesses outside the franchisee's Trade Area, or businesses under different names within or outside the Trade Area. The franchisor may also sell products through various channels (including the internet) within or outside the Trade Area. There is a 3-month exemption from performing work in a new protected territory for original franchisees. Franchisees do not receive an exclusive territory and may face competition from other franchisees, company-owned outlets, or other distribution channels. Franchisees may not solicit or accept orders from customers outside their Trade Area without consent and may incur an Infringement Fee for doing so. |
