DescriptionFranchisees are granted an exclusive territory, meaning the franchisor will not establish another franchise, affiliate, or company-owned unit using the Dog Training Elite trademark within that territory. Renewal ConditionsTo renew, you must be in good standing, comply with material terms and operating standards, timely pay all monetary obligations, not be subject to pending litigation, pay a successor franchise fee, modernize your business to current standards, and sign the then-current franchise agreement. You must give notice of intent to renew between 6 and 12 months prior to expiration.

Transfer ConditionsConditions to transfer include: franchisee not in default, all fees current, new franchisee qualifies (meeting current standards for net worth, financial resources, creditworthiness, health, background, training, personality, reputation, and business experience), transfer and training fees paid, purchase agreement approved, training for new transferee arranged, new transferee signs the then-current franchise agreement, and a release is signed by the transferring franchisee. The transferring franchisee must also coordinate with the transferee to ensure business coverage during training.
Termination for CauseThe franchisor can terminate the agreement for material breaches if the franchisee fails to cure within 15 to 30 days. Non-curable defaults include: insolvency, repeated breaches (3+ times in 12 months), unauthorized use of the system, public safety threat, material misrepresentations, abandonment, unauthorized transfer, false reporting, felony conviction or moral turpitude crime, unauthorized competition, termination of lease, failure to obtain financing, or termination of another agreement with the franchisor. Curable defaults (15-30 days) include failure to pay fees, failure to accurately report, unauthorized product re-sell, or default notice on a lease agreement.

Non-Compete DetailsDuring the term of the franchise agreement, the franchisee, its principals, and immediate family cannot be involved in any competing dog training or obedience training business without written consent. After termination, transfer, or expiration, for a continuous, uninterrupted period of three years, they cannot be a participant in or have any interest in a competing business within the former territory(ies), within 50 miles of the former territory(ies), or within 50 miles of any other Dog Training Elite franchise, company, or affiliate-owned business. Additionally, for three years post-term, they cannot solicit any former or current customers of the franchise business or the franchisor (with whom they interacted) for a competing business.

However, we do require on-premises supervision by your designated manager who must be trained by us to manage your franchise business unless your operating principal will act as the full-time manager of the franchise business. Supply RestrictionsYou must operate your franchise business according to our system, including purchasing or leasing certain items or services according to our specifications, from approved suppliers. You must not deviate from these methods, standards and specifications without our prior written consent. We reserve the right for us or an affiliate to be an approved supplier or the only approved supplier of any of the items listed in the above table. Additionally, we reserve the right to require that all items used in the operation of your business be purchased from us or other sources designated or approved by us. If you desire to use an unapproved supplier, you must submit a written request and pay a $250 evaluation fee plus reasonable expenses.
