In addition, because we have the right to establish Restaurants at Non-Traditional Sites (which may be within your Designated Territory), your Designated Territory is not exclusive to you. If you do not yet have an Accepted Location at the signing of the Franchise Agreement, you will receive a non-exclusive site search area listed in Attachment 1 of the Franchise Agreement instead.

Renewal ConditionsThe successor term is granted automatically. Within the last six months of the term of your Franchise Agreement, we will send you a bill for the successor agreement fee as well as any documents that you must sign for the successor term, which may include a successor Franchise Agreement and a release. If you do not pay the successor agreement fee and sign the documents we require, you will not be extended for a successor term.

Participation DetailsYou must designate and retain at all times an individual to serve as the “General Manager”. We recommend, but do not require, that you or one of your Principals acts as the General Manager. Although we do not require you to be actively involved in the daily operation of your Restaurant, you must still make sure that your Restaurant is being operated according to the terms of your Franchise Agreement and the Manual.
Required SuppliersOur Manual contains a list of vendors and suppliers you are required to use.
Supply RestrictionsYou must obtain all food and beverage items, ingredients, supplies, materials, fixtures, furnishings, equipment (including point-of-sale system and communication systems), and other products used or offered for sale at the Restaurant solely from suppliers who demonstrate, to our continuing reasonable satisfaction, the ability to meet our then-current standards or in accordance with our standards and specifications. A complete list of our approved products and suppliers will be included in the Manual and is subject to change over time. We will provide you notice in the Manual or otherwise in writing (such as via email) of any changes to the lists of approved products and approved suppliers. You will use only our proprietary recipes and other Proprietary Products and will purchase all of your inventory of those items solely from us or from a source designated by us.
